North Carolina Secures $590 Million PFAS Settlement From DuPont

North Carolina reached a $590 million settlement with DuPont, Chemours, and Corteva to resolve PFAS contamination claims linked to the Fayetteville Works plant.

North Carolina has finalized a $590 million settlement with DuPont, Chemours, and Corteva to resolve claims involving PFAS contamination. This is the largest environmental damage recovery in state history. The agreement concludes a legal battle the state initiated in 2020 regarding the Fayetteville Works plant and the use of PFAS-containing firefighting foam.

"Out of this $590 million settlement, $380 million will be allocated to go directly to the local communities that were most impacted," said North Carolina Attorney General Jeff Jackson in a statement.

Settlement Structure and Allocation

The total recovery consists of two components intended to provide relief and financial security for affected regions. According to a report from WRAL, the agreement includes $455 million in direct payments to the state and 11 local entities, distributed over a period of 10 to 15 years.

Additionally, the companies have committed to a $135 million reserve fund. This capital is earmarked to ensure that cleanup operations and drinking water protection programs remain funded if Chemours fails to meet its ongoing obligations under a 2019 consent order.

Historical Context of the Litigation

This settlement follows years of regulatory and legal pressure regarding the Fayetteville Works facility. The 2019 consent order established initial cleanup requirements. The state's 2020 lawsuit expanded the scope of the claims by seeking damages for the environmental and public health impacts of per- and polyfluoroalkyl substances (PFAS) in the region.

PFAS are known as "forever chemicals" because of their persistence in the environment and human body. They have been a focal point of environmental litigation across the United States. The North Carolina deal provides a benchmark for how states manage the costs associated with legacy industrial contamination.
