Federal regulators and seven state attorneys general filed a joint contempt motion in federal court alleging that Martin Shkreli violated his lifetime ban from the pharmaceutical industry by trading drug stocks and livestreaming market commentary.

"A lifetime industry ban is only effective if breaches are met with consequences commensurate with the seriousness of the order," said FTC Commissioner Mark Meador in a statement regarding the filing.

According to the CNBC report, the joint filing asserts that Shkreli acquired equity stakes in at least 60 pharmaceutical companies following his release from federal prison in May 2022. Regulators state he utilized social media platforms including YouTube, X, and Reddit to broadcast financial strategies and market commentary concerning the sector.

Origins of the Lifetime Ban

The permanent injunction carrying the industry ban was originally issued by the U.S. District Court for the Southern District of New York. That litigation stemmed from actions where Shkreli engineered a monopoly over the life-saving parasitic infection medication Daraprim, raising its price from $17.50 to $750 per pill.

"After a full trial, the court found that Martin Shkreli's conduct drove up prescription drug costs for American patients and blocked the entry of lower-cost generics," stated Daniel Guarnera, director of the FTC's Bureau of Competition.

Proposed Penalties and Enforcement Mechanisms

To address the alleged violations, the multi-state and federal filing outlines financial and legal remedies against Shkreli. Proposed penalties include:

  • Mandatory divestment of all healthcare and pharmaceutical holdings
  • Profit disgorgement without offsetting losses incurred across his portfolio
  • Escalating financial penalties or custodial consequences for any subsequent infractions

Additionally, the legal action targets associates who allegedly facilitated the circumvention of the original court order. According to the Investing.com report, the filing requests that a federal judge order Shkreli's sister, Leonora Izerne, and significant other, Chelsea Voss, to preserve evidence, citing indications that they assisted in breaching the injunction terms.

Regulatory Scrutiny on Compliance

The contempt motion highlights enforcement challenges surrounding judicial injunctions imposed on high-profile executives. By pursuing contempt charges alongside seven states, the Federal Trade Commission aims to establish strict compliance boundaries for individuals permanently barred from participating in critical healthcare and pharmaceutical markets.
