CFPB Adopts Expedited Reviews and Reduced Oversight

The CFPB has shifted toward expedited reviews for over half of its recent company examinations, raising concerns about long-term consumer protection risks.

The Consumer Financial Protection Bureau (CFPB) has adopted a more lenient supervisory approach, as more than half of its examinations this year were processed as expedited reviews. This shift departs from historical enforcement norms, because these reviews were typically reserved for firms with minor lapses and negligible risk of consumer harm.

As part of this transition, the agency introduced a humility pledge that examiners must recite during inspections. The policy mandates that staff work efficiently, transparently, and collaboratively with the financial institutions under their purview.

"That doesn't mean we're taking an approach to do... as little as possible," said Russell Vought, former acting director of the CFPB, in a statement regarding the shift in supervisory strategy.

Concerns Over Long-Term Consumer Risk

The move toward expedited oversight has drawn scrutiny from former agency officials who argue that the policy may undermine the bureau's mandate to protect the public. Critics suggest that the rapid processing of examinations could leave systemic compliance failures unaddressed.

"A significant number of expedited track reviews suggest to me that either political leadership simply picked the wrong companies to examine, or that when violations are identified, career staff are being told to back off," said Austin Hinkle, former senior counsel in the CFPB's Supervision Division, according to a Reuters report.

Legal and regulatory professionals warn that the current strategy creates a blind spot in the financial sector. Larry Lee, a former CFPB attorney, noted that today's undiscovered compliance issues may fester and explode into tomorrow's widespread but preventable consumer injuries. Lorelei Salas, former director of supervision at the agency, characterized the broader outlook as pretty grim for consumers in the United States.

The Mechanism of Expedited Reviews

In standard regulatory practice, examinations involve deep-dive audits of a company's internal controls, lending practices, and consumer data handling. Historically, these processes are time-intensive and often lead to enforcement actions or consent orders when violations are uncovered.

By contrast, the expedited review process streamlines these audits by focusing on high-level compliance indicators rather than granular transaction testing. While this reduces the administrative burden on both the regulator and the financial institution, it limits the agency's ability to identify deeper, complex patterns of misconduct that may not be immediately visible on the surface of a firm’s operations.
