The 9th U.S. Circuit Court of Appeals has blocked prediction market platform Kalshi from offering sports event contracts on two California tribal reservations. The court ruled that the activity likely violates the federal Indian Gaming Regulatory Act. This 3-0 decision creates a legal hurdle for the platform, which has sought to position its offerings as regulated financial derivatives instead of gambling products.
"This ruling is hard to square with other federal laws, which leave regulation of on-exchange derivatives trades exclusively to the [Commodity Futures Trading Commission]," said Elisabeth Diana, a Kalshi spokesperson, in a statement.
Defining the Legal Conflict
The appellate court’s opinion, authored by Circuit Judge Margaret McKeown, centered on the classification of the platform's activity. The court determined that each contract offered by Kalshi on the lands of the Blue Lake Rancheria and the Chicken Ranch Rancheria of Me-Wuk Indians constituted an act of placing a bet or wager. Because these specific activities were not authorized under existing tribal gaming ordinances or approved by the U.S. Department of the Interior, the court concluded they fell outside the scope of legal tribal gaming operations.
This dispute highlights the tension between prediction markets and established gaming regulations. While Kalshi operates under the oversight of the Commodity Futures Trading Commission (CFTC) for its broader financial products, the court’s ruling suggests that tribal sovereignty and the Indian Gaming Regulatory Act impose constraints on where and how such contracts can be deployed.
Stakeholder Perspectives
For the affected tribes, the ruling represents a defense of their jurisdictional authority over gaming activities on their land. Legal counsel for the tribes indicated that the conflict could have been avoided had the platform implemented technological restrictions.
"It’s a tremendous victory for the tribes. What Kalshi is doing is immoral. It could have easily spent a few million dollars to geofence the tribes’ operations," said Les Marston, a lawyer for the tribes.
Market and Operational Impact
The decision carries immediate consequences for fintech companies that have integrated prediction market services. Robinhood Markets, which routes customer orders for event contracts through Kalshi’s infrastructure, noted that the restriction on tribal land access would result in a loss of business volume.
As these platforms navigate the intersection of federal commodities law and state-level gambling statutes, the 9th Circuit's decision reinforces the regulatory challenges inherent in scaling prediction markets across diverse legal jurisdictions.
