Oxford Nanopore secured a preliminary injunction from the Unified Patent Court against MGI Tech, halting sales of competing CycloneSEQ systems across key European jurisdictions.
Scope of the Court Order
The Munich Local Division of the Unified Patent Court granted the preliminary injunction against MGI Tech GmbH, effectively preventing the company from commercializing specific sequencing platforms. The ruling takes effect immediately across multiple European territories.
The prohibition covers making, offering, placing on the market, using, importing, storing, or supplying the CycloneSEQ-WT02, CycloneSEQ-WY01, G100-ER, and G400-ER systems. The court order also applies to related flow cells and any other sequencer hardware utilizing materially similar underlying technology.
Patent Infringement Claims
The legal dispute centers on core intellectual property held by Oxford Nanopore. According to the court filing details, Oxford Nanopore claimed that MGI Tech's Cyclone Sequencing Systems infringe two specific European patents: EP 2 422 198 and EP 2 715 343.
The preliminary injunction applies across a broad geographic footprint, covering:
- Denmark
- France
- Germany
- The Netherlands
- Liechtenstein
- Switzerland
- The United Kingdom
- Ireland (with restrictions limited specifically to systems used with a flow cell)
Next Legal Steps
While the preliminary ruling provides immediate market protection for Oxford Nanopore, the litigation remains ongoing. The Unified Patent Court has scheduled the formal trial hearing for October 2027 as Oxford Nanopore pursues a permanent injunction against MGI Tech's product line.
