NHTSA Audits Tesla Cybercab Fleet Over Safety Compliance
NHTSA audits Tesla's steering-wheel-free Cybercab robotaxi fleet in Austin, testing U.S. vehicle self-certification rules and safety standards.

Tesla's rollout of its steering-wheel-free Cybercab robotaxi service in Austin has triggered an immediate audit from federal regulators, testing the boundaries of U.S. vehicle self-certification rules.
The National Highway Traffic Safety Administration opened an audit of about 1,000 Cybercab vehicles to assess how Tesla determined the cars comply with federal vehicle-safety standards. The regulatory scrutiny places the electric vehicle maker at the center of a growing debate over how autonomous cars without conventional controls navigate federal oversight.
"I don't think there is a reasonable interpretation that can be made to suggest that the Cybercab can comply with the Federal Motor Vehicle Safety Standards," said Michael Brooks, executive director of the Center for Auto Safety, a consumer advocacy group.
How U.S. Self-Certification Works
Unlike jurisdictions that require pre-market government approval, the U.S. system relies heavily on manufacturer self-certification. Under federal rules, automakers evaluate their own vehicles against dozens of Federal Motor Vehicle Safety Standards (FMVSS) before selling them to the public.
This framework has historically accommodated gradual modifications to conventional cars. However, removing traditional controls like steering wheels, brake pedals, and rearview mirrors forces manufacturers to interpret standards written decades ago for human-driven vehicles.
Legal scholars and safety researchers note that testing these boundaries is consistent with the manufacturer's operational history.
"Tesla historically has tested limits and pushed boundaries on regulations. I fully expect Tesla to test the limits," said Philip Koopman, a Carnegie Mellon University engineering professor and autonomous-vehicle safety expert.
Regulatory Precedent and Production Timelines
The NHTSA audit evaluates a critical inflection point for the company's autonomous vehicle ambitions. Tesla started manufacturing the Cybercab in April, and Chief Executive Elon Musk promised production would grow exponentially later in the year or next.
Despite the manufacturing ramp-up, external observers question whether the underlying technology matches the deployment timeline.
"No public information about Tesla's capabilities suggests that Tesla is anywhere close to being able to safely and reliably deploy an automated driving system over the wide range of conditions that would be required for a vehicle without conventional controls," said Bryant Walker Smith, a University of South Carolina law professor focused on autonomous-driving regulation.
What is at stake is the integrity of the federal self-certification model for autonomous fleets. If regulators find that the Cybercab fleet fails to meet established standards, the outcome could reshape how driverless vehicles enter public roadways nationwide.
